1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the SnapSavvy Photography website (the "Site") and any photography services booked through it (the "Services"), operated by SnapSavvy Photography ("we," "us," "our"), based in Hamilton, Ontario, Canada.

By accessing the Site, submitting a booking inquiry, or engaging our Services, you ("you," "the Client") agree to be bound by these Terms. If you do not agree, please do not use the Site or book our Services.

2. Services Offered

SnapSavvy Photography provides professional photography services, including but not limited to:

• Real estate photography for property listings

• Portrait, couples, and engagement photography

Specific deliverables, session length, number of edited images, and pricing for any given booking will be confirmed in writing (email or a signed service agreement/invoice) prior to the session. Where a separate signed contract exists for a booking, that contract governs the specific engagement and these Terms apply to all other use of the Site and as a general background agreement.

3. Bookings, Deposits, and Payment

• A booking is only confirmed once a retainer/deposit (if required) has been received and acknowledged by us.

• Full payment is due as specified on your invoice, generally on or before delivery of final images unless otherwise agreed in writing.

• Prices are in Canadian dollars (CAD) and, where applicable, GST/HST will be added in accordance with the Excise Tax Act.

• We reserve the right to update our pricing at any time; the price confirmed at the time of your booking will be honoured for that booking.

4. Cancellations and Rescheduling

• Clients may request to reschedule a session, subject to availability, by providing as much notice as possible.

• Deposits are generally non-refundable, as they reserve time and resources exclusively for your session, but may be applied toward a rescheduled date at our discretion.

• We reserve the right to reschedule or cancel a session due to circumstances outside our control (illness, extreme weather, equipment failure, safety concerns, etc.), in which case we will work with you in good faith to find a new date or issue an appropriate refund of monies paid for services not rendered.

• For outdoor sessions (e.g., engagement or portrait shoots), sessions may need to be rescheduled due to weather; we will make reasonable efforts to find a mutually convenient alternate date.

5. Copyright and Ownership of Images

• Under Canada's Copyright Act, SnapSavvy Photography, as the photographer, retains copyright and ownership of all images captured during a session, unless copyright is expressly transferred in a separate written agreement.

• Booking a session does not transfer copyright to the Client. Clients receive a license to use delivered images as described in Section 6.

• We reserve the right to display images from Client sessions in our portfolio, on this Site, and on social media for promotional purposes, unless the Client requests otherwise in writing (for example, where privacy is a concern, such as certain real estate listings prior to public marketing, or personal portrait sessions).

6. Usage License for Clients

Upon full payment, Clients receive a personal or business-use license to the final delivered images as follows:

• Portrait/couples/engagement clients: a non-exclusive, non-transferable license to use delivered images for personal, non-commercial purposes (printing, sharing, social media), with photographer credit appreciated where practical.

• Real estate clients: a non-exclusive license to use delivered images for the marketing and sale/lease of the specific property photographed (listings, brochures, MLS, social media), for the duration of that listing, unless a different scope is agreed in writing.

• Clients may not sell, sublicense, alter the copyright notice on, or claim authorship of the images, and may not use images for purposes beyond the scope granted without our prior written consent.

• Any request for extended or exclusive licensing (e.g., ongoing commercial use, resale, third-party licensing) must be arranged separately and may involve an additional fee.

7. Model Releases and Privacy

• By booking a session involving identifiable individuals, the Client confirms they have the authority to consent, and consent on behalf of any other individuals appearing in the images (e.g., family members, or in the case of minors, their legal guardian), to being photographed and to the uses described in Section 5 and 6.

• We collect and use personal information (such as your name, email, and phone number) solely to administer bookings and provide Services, in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). For details on how we handle personal information collected through the Site, please refer to our separate Privacy Policy.

8. Delivery of Images

• Edited images will be delivered digitally (e.g., online gallery or download link) within the timeframe communicated at booking, typically within a specified number of business days following the session, unless otherwise agreed.

• We do not guarantee retention of raw/unedited files or delivered galleries indefinitely; Clients are encouraged to download and back up their images promptly upon delivery.

• Any request for prints, albums, or physical products is subject to separate terms and pricing.

9. Website Use

When using the Site generally (browsing, contacting us through forms, etc.), you agree to:

• Provide accurate information when submitting inquiries or booking requests;

• Not use the Site for any unlawful purpose or in a way that could damage, disable, or impair the Site;

• Not attempt to copy, scrape, or reproduce the content of the Site (including images, text, and branding) without our written permission.

All content on the Site, including our logo, branding, written content, and photographs, is the property of SnapSavvy Photography and is protected by applicable copyright and trademark law, unless otherwise credited.

10. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis. While we take care to ensure the accuracy of information on the Site, we make no warranties or representations, express or implied, about the completeness, accuracy, or reliability of the Site's content. Photography is a creative service, and while we strive to meet Client expectations discussed at booking, we cannot guarantee specific artistic outcomes.

11. Limitation of Liability

To the fullest extent permitted by law:

• SnapSavvy Photography's total liability arising out of or related to any Services will not exceed the amount paid by the Client for the specific session in question.

• We are not liable for indirect, incidental, or consequential damages, including loss of income or opportunity, arising from delays, technical issues, or unforeseen circumstances (including equipment failure or data loss) affecting a session or image delivery, except where such limitation is not permitted by applicable law (such as Ontario's Consumer Protection Act).

• We are not responsible for how third parties (e.g., real estate platforms, social media services) display, compress, or use delivered images once shared by the Client.

12. Indemnification

You agree to indemnify and hold SnapSavvy Photography harmless from any claims, damages, or expenses arising from your breach of these Terms, misuse of delivered images beyond the granted license, or your provision of inaccurate consent regarding individuals photographed.

13. Third-Party Links

The Site may contain links to third-party websites (e.g., social media, listing platforms). We are not responsible for the content, privacy practices, or terms of any third-party sites.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal reasons. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Site or booking of Services after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Site/Services will be subject to the exclusive jurisdiction of the courts of Ontario.
